• Welcome to the shegatravel.com website (the "Website"). This Website is provided solely to assist customers in gathering travel information, determining the availability of travel—related goods and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for no other purposes.
• The terms "we", "us", "our", “Shega Travel” refers to Shega Travel Agency and Kifiya Financial Technology PLC. The term "you" or “customer” refers to the customer visiting or using the Website and/or booking a reservation through us on this Website, or through our customer service agents. The term “end service provider” refers to the Airlines, the Hotels, the Tour Operators and Car rentals.
• These Terms of Service (“Terms”,“Terms of Service”) govern your use of our website located at www.shegatravel.com (together or individually “Service ”) operated by Shega Travel.
• Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.
• Any person ("Customer") who inquiries about or purchases any products or services of Shega Travel through its websites, mobile applications, sales persons, call centers, franchisees, agents etc. (all the aforesaid platforms collectively referred to as "Sales Channels") agree to be governed by this Terms of Use. The websites and the mobile applications of Shega Travel are collectively referred to as 'Website'.
• Both Customer and Shega Travel are individually referred to as 'Party' and collectively referred to as 'Parties' to the Terms of Use.
• "Terms of Use" available on Shega Travel‘s website details out terms & conditions applicable on various services or products facilitated by Shega Travel. The Customer should refer to the relevant Terms of Service applicable for the given product or service as booked by the Customer. Such Terms of Service are binding on the Customer.
• Your agreement with us includes these Terms and our Privacy Policy (�Agreements�). You acknowledge that you have read and understood Agreements, and agree to be bound of them.
• If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at book@shegatravel.com so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

• We will send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction or booking made by the Customer, via SMS, internet-based messaging applications like WhatsApp, voice call, e-mail or any other alternate communication detail provided by the User at the time of booking.
• Shega Travel may also contact the Customer through the modes mentioned above for any pending or failed bookings, to know the preference of the Customer for concluding the booking and also to help the Customer for the same.

The Customer hereby unconditionally consents that such communications via SMS, internet-based messaging applications like WhatsApp, voice call, email or any other mode by Shega Travel are:

• upon the request and authorization of the Customer;
• 'transactional' and not an 'unsolicited commercial communication' as per the guidelines of Ethiopian Communication Authority, and
• in compliance with the relevant guidelines of Ethiopian Communication Authority or such other authority in Ethiopia and abroad.

• The Customer must be at least 18 years of age and must possess the legal authority to enter into an agreement so as become a Customer and use the services of Shega Travel. If you are a minor or are below the age of 18 years, you shall not register as a Customer of the Website and shall not transact on or use the Website.
• As a minor if you wish to use or transact on the Website, such use or transaction shall only be made by a person of legal contracting age (legal guardian or parents). We reserve the right to terminate your membership and/or block access to the Website if it is discovered that you are a minor or incompetent to contract according to the law or any information pertaining to your age entered at the time of creation of account is false.
• Before using the Website, approaching any Sales Channels or procuring the services of Shega Travel, the Customers shall compulsorily read and understand this Terms of Use, and shall be deemed to have accepted this Terms of Use as a binding document that governs Customer's dealings and transactions with Shega Travel. If you do not agree with any part of this Agreement, then you must not avail our services and must not access or approach the Sales Channels of Shega Travel.
• All rights and liabilities of the Customer and Shega Travel with respect to any services or product facilitated by Shega Travel shall be restricted to the scope of this Terms of Use.

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter”, “spam” or any other similar solicitation.
• To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
• To engage in any other conduct that restricts or inhibits anyone‘s use or enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service or expose them to liability.

• Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party‘s use of Service, including their ability to engage in real time activities through Service.
• Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service.
• Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent.
• Use any device, software, or routine that interferes with the proper working of Service.
• Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Service, the server on which Service is stored, or any server, computer, or database connected to Service.
• Attack Service via a denial-of-service attack or a distributed denial-of-service attack.
• Take any action that may damage or falsify Company rating.
• Otherwise attempt to interfere with the proper working of Service.

• The Website is meant to be used by Customer(s) for a lawful use.
• You shall not distribute exchange, modify, sell or transmit anything from the Website, including but not limited to any text, images, audio and video, for any business, commercial or public purpose.
• The Terms of Use grants a limited, non-exclusive, non-transferable right to use this Website as expressly permitted in this Terms of Use. You agree not to interrupt or attempt to interrupt the operation of the Website in any manner whatsoever.
• Access to certain features of the Website may only be available to registered User(s). The process of registration, may require you to answer certain questions or provide certain information that may or may not be personal in nature. Some such fields may be mandatory or optional. You represent and warrant that all information supplied to us is true and accurate.
• We reserve the right, in our sole discretion, to terminate the access to the Website and the services offered on the same or any portion thereof at any time, without notice, for general maintenance or any other reason whatsoever.
• We will always make our best endeavors to ensure that the content on our websites or other sales channels are free of any virus or such other malwares. However, any data or information downloaded or otherwise obtained through the use of the Website or any other Sales Channel is done entirely at your own discretion and risk and you will be solely responsible for any damage to your computer systems or loss of data that may result from the download of such data or information.
• We reserve the right to periodically make improvements or changes in our Website at any time without any prior notice to the Customers You are requested to report any content on the Website which is deemed to be unlawful, objectionable, libelous, defamatory, obscene, harassing, invasive to privacy, abusive, fraudulent, against any religious beliefs, spam, or is violative of any applicable law to info@shegatravel.com. On receiving such report, Shega Travel reserves the right to investigate and/or take such action as the Company may deem appropriate.

• Except with the prior registration with Us as B2B agents, priority partner or a franchisee, and explicit permission of Us to use the Website, all travel agents, tour operators, consolidators or aggregators ("Travel Agents") are barred from using this Website for any commercial or resale purpose. If any such bookings are detected, Shega Travel reserves the right, including without limitation, to cancel all such bookings immediately without any notice to such travel agents and also to withhold payments or any refunds thereto. We shall not be held liable for any incidental loss or damage that may arise from the bookings made by any person through such Travel Agents. The liability in case of such cancellations shall be solely borne by such Travel Agents.
• All discounts and offers mentioned on the Website are applicable only to our customers for legitimate bookings.

• Shega Travel always acts as a facilitator by connecting the Customer with the respective service providers like airlines, hotels, tour operators and Car rentals. (collectively referred to as "Service Providers"). Our liability is limited to providing the Customer with a confirmed booking as selected by the Customer.
• Any issues or concerns faced by the Customer at the time of availing any such services shall be the sole responsibility of the Service Provider. We will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence on part of any Service Provider.

Unless explicitly committed by Shega Travel as a part of any product or service:

• We assume no liability for the standard of services as provided by the respective Service Providers.
• We provide no guarantee with regard to their quality or fitness as represented.
• We don't guarantee the availability of any services as listed by a Service Provider.

• In addition to the cost of booking as charged by the Service Providers, Shega Travel reserves the right to charge certain fees in the nature of convenience fees or service fees. Shega Travel further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to the Customer before confirming the booking or collecting the payment from the Customer.
• In cases of short charging of the booking amount, taxes, statutory fee, convenience fee etc., owing to any technical error or other reason, Shega Travel shall reserve the right to deduct, charge or claim the balance amount from the Customer and the Customer shall pay such balance amount to Shega Travel. In cases where the short charge is claimed prior to the utilization of the booking, Shega Travel will be at liberty to cancel such bookings if the amount is not paid before the utilization date.
• Any increase in the price charged by Shega Travel on account of change in rate of taxes or imposition of new taxes, levies by Government shall have to be borne by the Customer. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.
• In the rare circumstance of a booking not getting confirmed for any reason whatsoever, Shega Travel will process the refund of the booking amount paid by the Customer and intimate the Customer about the same. Shega Travel is not under any obligation to provide an alternate booking in lieu of or to compensate or replace the unconfirmed booking. All subsequent bookings will be treated as new transactions. Any applicable refund will be processed as per the defined policies of the service provider and Shega Travel as the case may be.
• The Customer shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the service, as per the applicable laws.
• The Customer agrees and understands that all payments shall only be made to bank accounts of Shega Travel. Shega Travel or its agents, representatives or employees shall never ask a customer to transfer money to any private account or to an account not held in the name of Shega Travel or Kifiya Financial Technology PLC. The Customer agrees that if that customer transfers any amount against any booking or transaction to any bank account that is not legitimately held by Shega Travel or to any personal account of any person, Shega Travel shall not be held liable for the same. Customer shall not hold any right to recover from Shega Travel any amount which is transferred by the Customer to any third party.
• The User will not share his personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the agents, employees or representatives of Shega Travel. The User shall immediately inform Shega Travel if such details are demanded by any of its agents' employees or representatives. Shega Travel shall not be liable for any loss that the Customer incurs for sharing the aforesaid details.
• Refunds, if any, on cancelled bookings will always be processed to the respective account or the banking instrument (credit card, bank account, debit card etc.) from which payment was made for that booking.
• Booking(s) made by the Customer through Our Website are subject to the applicable cancellation policy as set out on the booking page or as communicated to the customers in writing.

• Customers are advised to check the description of the services and products carefully before making a booking. Customer(s) agree to be bound by all the conditions as contained in booking confirmation or as laid out in the confirmed booking voucher. These conditions are also to be read in consonance with the User Agreement.
• If a Customer intends to make a booking on behalf of another person, it shall be the responsibility of the Customer to inform such person about the terms of this Agreement, including all rules and restrictions applicable thereto.
• The Customer undertakes to abide by all procedures and guidelines, as modified from time to time, in connection with the use of the services available through Shega Travel. The Customer further undertakes to comply with all applicable laws, regulations, orders, directions etc. issued by the Federal Government of Ethiopia and State Government, or any other statutory body empowered to do so with respect to use of services or for each transaction.
• The services are provided on an "as is" and "as available" basis. Shega Travel may change the features or functionality of the services being provided at any time, in its sole discretion, without any prior notice. Shega Travel expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, reasonably fit for all purposes. No advice or information, whether oral or written, which the Customer obtains from Shega Travel or through the services opted shall create any warranty not expressly made herein or in the terms and conditions of the services.
• Customer also authorizes Shega Travel's representative to contact such user over phone, message and email.

• While registering on the Website, you will have to choose a password to access your account and you shall be solely responsible for maintaining the confidentiality of both the password and the account as well as for all activities on the account. It is your duty to notify Us immediately in writing of any unauthorized use of your password or account or any other breach of security. We will not be liable for any loss that may be incurred by you as a result of unauthorized use of the password or account, either with or without your knowledge. The Customer shall not use anyone else's account at any time.
• The Customer understands that any information that is provided to this Website may be read or intercepted by others due to any breach of security at the Customer's end.
• Shega Travel keeps all the data in relation to credit card, debit card, bank information etc. secured and in an encrypted form in compliance with the applicable laws and regulations. However, for cases of fraud detection, offering bookings on credit (finance) etc., Shega Travel may at times verify certain information of its Customers like their credit score, as and when required.
• We adopt the best industry standard to secure the information as provided by the Customer. However, We cannot guarantee that there will never be any security breach of our systems which may have an impact on Customer's information too.
• The data of the Customer as available with Shega Travel may be shared with concerned law enforcement agencies for any lawful or investigation purpose without the consent of the Customer.

• Unless explicitly provided by Us in any specific service or deliverable, obtaining sufficient insurance coverage is the obligation of the Customer. In no case We shall accept any claims arising out of such scenarios.
• Insurance, if any provided as a part of the service or product by Shega Travel shall be as per the terms and conditions of the third-party insurance company. Shega Travel merely acts as a facilitator in connecting the Customer with insurance company. The Customer shall contact the insurance company directly for any claims or disputes. Shega Travel shall not be held liable in case of partial acceptance or denial of the claims by the insurance company.

• International bookings made through Our Website or Sales Channel are subject to the requirements of visa including but not limited to transit visa, OK TO BOARD which are to be obtained by the Customer as per the requirement of their travel bookings and the requirements of the countries the Customer intends to visit or transit through.
• Shega Travel is not responsible for any issues, including inability to travel, arising out of such visa requirements and is also not liable to refund any amount to the Customer for being unable to utilize the booking due to absence or denial of visa, irrespective whether or not the Customer has availed the services of Shega Travel for the visa process too. Refund, if any, will be as per the applicable terms of booking and cancellation policy.

• There can be exceptional circumstances where Shega Travel and / or the Service Providers may be unable to honor the confirmed bookings due to various reasons like act of God, labor unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, any operational and technical issues, route and flight cancellations etc. or any other reason beyond our control. If we have advance knowledge of any such situations where dishonor of bookings may happen, we will make our best efforts to provide similar alternative to the Customer or refund the booking amount after deducting applicable service charges, if supported and refunded by that respective service operators. The Customer agrees that Shega Travel being merely a facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance. The Customer has to contact the Service Provider directly for any further resolutions and refunds.
• The Customer agrees that in the event of non-confirmation of booking due to any technical reasons (like network downtime, disconnection with third party platforms such as payment gateways, banks etc.) or any other similar failures, Shega Travel‘s obligation shall be limited refunding the booking amount, if any, received from the customer. Such refund shall completely discharge Shega Travel from all liabilities with respect to that transaction. Additional liabilities, if any, shall be borne by the Customer.
• In no event shall Shega Travel and be liable for any direct, indirect, punitive, incidental, special or consequential damages, and any other damages like damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website or any other Sales Channel.

• Shega Travel at its sole discretion reserves the right to not accept any booking without assigning any reason thereof.
• Shega Travel will not provide any service or share confirmed booking details till such time the complete consideration is received from the Customer.

In addition to other remedies and recourse available to Shega Travel under this User Agreement or under applicable law, Shega Travel may limit the Customer's activity, warn other users of the Customer's actions, immediately suspend or terminate the Customer's registration, or refuse to provide the Customer with access to the Website if:

• The Customer is in breach of this Terms of use; or
• Shega Travel is unable to verify or authenticate any information provided by the Customer; or
• Shega Travel believes that the Customer‘s actions may infringe on any third-party rights or breach any applicable law or otherwise result in any liability for the Customer, other users of Shega Travel, or Shega Travel itself.

• Once a Customer has been suspended or terminated, such Customer shall not register or attempt to register with Shega Travel with different credentials, or use the Website in any manner whatsoever until such Customer is reinstated by Shega Travel. Shega Travel may at any time in its sole discretion reinstate suspended users.
• If a Customer breaches this Terms of Use, Shega Travel reserves the right to recover any amounts due to be paid by the Customer to Shega Travel, and to take appropriate legal action as it deems necessary.

The Customer shall not write or send any content to Shega Travel which is, or communicate with Shega Travel using language or content which is:

• abusive, threatening, offensive, defamatory, coercive, obscene, belligerent, glorifying violence, vulgar, sexually explicit, pornographic, illicit or otherwise objectionable;
• contrary to any applicable law;
• violates third parties' intellectual property rights;
• a spam; or
• in breach of any other part of these terms and conditions of use.

• The Customer expressly undertakes to provide Shega Travel with correct and valid information while making use of the Website under this Terms of Use, and not to make any misrepresentation of facts. Any default on part of the Customer would disentitle the Customer from availing the services from Shega Travel.
• In case Shega Travel discovers or has reasons to believe at any time during or after receiving a request for services from the Customer that the request for services is either unauthorized or the information provided by the Customer or any of the travelers is not correct or that any fact has been misrepresented by that Customer, Shega Travel shall be entitled to appropriate legal remedies against the Customer, including cancellation of the bookings, without any prior intimation to the Customer. In such an event, Shega Travel shall not be responsible or liable for any loss or damage that may be caused to the Customer or any other person in the booking, as a consequence of such cancellation of booking or services.
• If any judicial, quasi-judicial, investigation agency, government authority approaches Shega Travel to cancel any booking, Shega Travel will cancel the same without approaching the concerned Customer whose booking has been cancelled.
• The Customer shall not hold Shega Travel responsible for any loss or damage arising out of measures taken by Shega Travel for safeguarding its own interest and that of its genuine customers. This would also include Shega Travel denying or cancelling any bookings on account of suspected fraud transactions.

• Shega Travel's employees or authorized representatives will never contact a Customer asking for his/ her credit or debit card number, expiry date, CVV, net banking login, passwords, OTP etc. nor will they ever request for a fund transfer to a personal or an individual bank account. Further, they will also not ask a Customer to install any third-party applications that enable them to view a User's mobile or computer screen.
• Acting on any of these requests may make you a victim of fraud, and may potentially lead to loss of your valuable money or information.
• If you are ever asked for any of the aforesaid information, please report it immediately to Risk, Compliance and IA‘ on bgulilat@kifiya.et

• The Customer agrees to indemnify, defend and hold harmless Shega Travel, its affiliates and their respective officers, directors, lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the Customer, or non-performance of any covenant by the Customer.
• The Customer shall be solely liable for any breach of any country specific rules and regulations or general code of conduct and Shega Travel cannot be held responsible for the same.

• You may provide us either directly at book@shegatravel.com or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

• Refunds should be requested before 14 days of the travel date.

• We may use third-party Service Providers to monitor and analyze the use of our Service.

• We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.
• If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to book@shegatravel.com , with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”
• You may be held accountable for damages (including costs and attorneys‘ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

• Our Service may contain links to third party web sites or services that are not owned or controlled by Shega Travel.
• Shega Travel has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

• YOU ACKNOWLEDGE AND AGREE THAT COMPANY SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH USE OF OR RELIANCE ON ANY SUCH CONTENT, GOODS OR SERVICES AVAILABLE ON OR THROUGH ANY SUCH THIRD PARTY WEB SITES OR SERVICES.
• WE STRONGLY ADVISE YOU TO READ THE TERMS OF SERVICE AND PRIVACY POLICIES OF ANY THIRD PARTY WEB SITES OR SERVICES THAT YOU VISIT.
• OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.
• COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
• THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
• ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY YOU OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF COMPANY HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF COMPANY, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

• These Terms shall be governed and construed in accordance with the laws of the Federal Government Ethiopia, which governing law applies to agreement without regard to its conflict of law provisions.
• Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.

• We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.

• We may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.
